No one requested an encore of the soap opera that unfolds the saga between Nikola Corp. NKLA and its embattled founder, Trevor Milton. Yet, here we are.

In the ongoing saga of Nikola Corp. and its controversial founder, Trevor Milton, the company found itself in a legal tangle after being unable to enforce a $167.7 million arbitration award in November. Milton’s subsequent attempt to overturn the award set the stage for a bitter feud.

Last month, Nikola countered by suing Milton in the U.S. District Court for the District of Arizona, seeking a temporary restraining order under the Arizona Uniform Fraudulent Transfer Act to prevent Milton from parting with his company stock until he settled the dues.

Court Decision on Nikola’s Bid

The court in Phoenix declined the restraining order, citing Nikola’s lack of substantiating evidence and casting doubts on the company’s ability to prove its case. However, it mandated Milton to clarify his actions pertaining to the sale of over 37 million Nikola shares through his M&M Residual LLC from Feb. 22 to March 13, drastically reducing Milton’s Nikola holdings.

Nikola accused Milton of obstructing their arbitration award collection efforts, claiming it was an intentional move by Milton to impede the process.

The ongoing saga extends to Nikola’s concerns about Milton potentially influencing board elections by nominating candidates with questionable qualifications, prompting the company to take pre-emptive measures to advise shareholders against such interference.

SEC Filing and Company Accusations

In a recent Securities and Exchange Commission filing, Nikola condemned its founder as a ‘disgraced’ felon attempting a corporate takeover by colluding with a party interested in Nikola assets. The filing pointed to breaches of a prior agreement and opened the door to legal action against involved parties.

Milton’s impending prison sentence has not deterred his involvement in Nikola’s affairs, illustrating the complexity and audacity of the situation.

Recalled Nikola Trucks

Despite the legal fracas, Nikola remains committed to rectifying previous missteps by initiating the return of recalled battery-electric vehicles to customers. The recall, triggered by safety concerns, reflects the company’s resolve to address past issues earnestly.

Customers can expect a resolution by the end of the second quarter, marking a positive step in restoring trust and credibility.
